COUNCIL PROCEEDINGS ‑ Council Chambers ‑ Kaukauna, Wisconsin – June 16, 2020.

Pursuant to adjournment on June 2, 2020 meeting of the Common Council of the City of Kaukauna was called to order by Mayor Penterman at 7:00 P.M. on Tuesday, June 16, 2020 with remote teleconference via ZOOM.

Roll call present:  Coenen, Driessen, DeCoster, Duda, Moore, Roehrig, Schell and Thiele.

Also present: DPW/Eng. Sundelius, Attorney Davidson, Planner Jakel, Police Chief Graff, Fire Chief Carrel, Library Dir. Theim-Menning, Finance Dir. Van Rossum, HR Dir. Vanderloop, IT Dir. Don Krause, and interested citizens.

One minute of silent prayer and the Pledge of Allegiance to the American Flag observed by the assembly with remote teleconference via ZOOM.

Motion by Coenen, seconded by Thiele to suspend the rules and waive the reading of the minutes of the previous meeting of June 2, 2020.

Public Appearances

Phil Kohne, 2106 Olde Country Circle, spoke regarding the ordinance allowing dogs in City parks.  He suggested that the City have four waste containers and two pet bag outlets at both ends of the Konkapot Trail.  He also inquired about the temporary stop signs that have been put up on Dodge Street.  He feels it is a waste of time, as no one adheres to it.  Mr. Kohne commented on the excellent job by Vinton Construction and Eng. Cesafsky in handling the reconstruction on Haas Road.

Business Presented by the Mayor

Mayor Penterman stated that this will be the last time the Committee and Council meetings will be held via ZOOM.  Future meetings will be held in person in the Council Chambers.

Appoint Kevin Hietpas to the Kaukauna Library Board to replace Cindy Fallona.

Motion by Coenen, seconded by Driessen to appoint Kevin Hietpas to the Kaukauna Library Board to replace Cindy Fallona.

Kaukauna K9 Update.

The head of the K9 Fund Raising Committee, Trevor Frank gave an update on the Kaukauna K9.  Currently, the fund balance in the Community Foundation is $66,827.  Frank thanked the entire K9 Committee, Kaukauna Library, Officer Meyer and Rocko, and local businesses who helped raise money to bring another K9 unit to the City of Kaukauna.

Police Chief Graff stated that Stephanie Maas will be the next K9 Officer.  She will be going to Albuquerque, New Mexico for six weeks starting in September for training.

BOARD OF PUBLIC WORKS

Meeting of the Board of Public Works called to order by Chairman Thiele at 6:00 P.M. on Monday, June 15, 2020 remote teleconference via ZOOM.

Members present: Coenen, DeCoster, Driessen, Duda, Moore, Roehrig, Schell, and Thiele.

Also present: DPW/Eng. Sundelius, Eng./GIS Spec. Neumeier, City Attorney Davidson, Planner Jakel, Street Sup. VandenHeuvel, Police Chief Graff, Fire Chief Carrel, Rec. Dir. Malloy, Principal Planner Watson Brunette, HR Dir. Vanderloop, and interested citizens.

1. Correspondence – none.
2. Open bids for Project #2-20, Cured in Place Pipe (CIPP).

Motion by Coenen, seconded by Moore to allow no more bids and open the bids received.

GIS/Eng. Neumeier opened the bids received.

Motion by Coenen, seconded by Schell to have the Engineering Department tabulate the bids and come back to the Board with a recommendation.

3. Authorization to seek bids on Project #6-20, Nelson Overlook Improvements.

DPW/Eng. Sundelius provided background information on Project #6-20, Nelson Overlook Improvements.  Previously the Board of Public Works approved entering into a contract with GRAEF to do the final design and construction documents for this project.

Motion by Moore, seconded by DeCoster to authorize the Engineering Department to seek bids on Project #6-20, Nelson Overlook Improvements.

4. Authorization to seek bids for replacement of a 2009 one-ton dump truck (fleet #6).

Street Superintendent VandenHeuvel gave background information on this vehicle.

Motion by Schell, seconded by Roehrig to authorize the Street Superintendent to seek bids for the replacement of a 2009 one-ton dump truck (fleet #6).

All Ald. voted aye.

5. Update on C.T.H. CE reconstruction and trail extension.

On May 4, 2020 the Board of Public Works authorized entering into a County/Municipal Agreement (CMA) with the Outagamie County Highway Department to reconstruct CTH CE and extend the CTH CE trail from Hillcrest Drive easterly to Haas Road.

The project costs listed in the CMA at that time was based on engineering estimates.  The City’s share of the project costs was estimated at $750,000 which was 32.7% of total project costs.  The project is now been bid and project costs are significantly lower than estimated.  The City’s estimated project costs have been reduced to $508,200 (30.2% of total project costs).  Background information was provided.  DPW/ Eng. Sundelius answered questions from the Board.

6. Update on concrete paving project.

DPW/Eng. Sundelius provided an update on the paving project.  Weekly updates can be provided to anyone interested via e-mail.

7. Update on alley reconstruction project.

DPW/Eng. Sundelius provided information on this successful project which is now complete.

8. Compliance Maintenance Annual Report (CMAR) to DNR.

Per Wisconsin DNR:  Chapter NR 208, Wis. Adm. Code is more commonly known as the Compliance Maintenance Annual Report (CMAR) rule for publicly and privately owned domestic wastewater treatment works.  The CMAR is a self-evaluation tool that promotes the owner’s awareness and responsibility for wastewater collection and treatment needs, measures the performance of a wastewater treatment works during a calendar year, and assesses its level of compliance with permit requirements.

Eng./GIS Spec. Neumeier provided report information and answered questions from the Board.

Motion by Coenen, seconded by Moore to receive and place on file and recommend adoption of the “City of Kaukauna-2019 Wisconsin Department of Natural Resources NR 208 – Compliance Maintenance Resolution” to Common Council.

All Ald. voted aye.

9. Special assessment public hearing schedule.

Wisconsin State Statutes require a hearing to be noticed and held as part of the process to levy special assessments against a property.  There are several public works projects where we intend to levy special assessments in 2020.  Staff is preparing to hold the required public hearings during the Board of Public Works meetings on two separate dates, July 20 and August 3.  Property owners have been notified of the proposed special assessment rates as was requested by the BPW.  Required formal notices will be sent out accordingly.

10. Approval of Commercial Lease Agreement for Veterans Memorial Lift Bridge Site Management.

Planner Jakel provided background information on the Commercial Lease Agreement with Lunda Construction and answered questions from the Board.

Motion by Schell, seconded by DeCoster to approve the Commercial Lease Agreement for Veterans Memorial Lift Bridge Site Management in the Carnegie Building.

FINANCE AND PERSONNEL COMMITTEE

A meeting of the Finance and Personnel Committee was called to order by Chairman Penterman on Monday, June 15, 2020 at 6:43 P.M. remote teleconference via ZOOM.

Members present:  Coenen, Duda, Moore, Roehrig, Schell, and Penterman.

Also present:  Ald. Driessen, DeCoster, Thiele, DPW/Eng. Sundelius, GIS Spec. Neumeier, Planner Jakel, Police Chief Graff, Street Superintendent Vandenheuvel, Finance Director Van Rossum, Rec. Dir. Malloy, Principal Planner Watson Brunette and interested citizens.

1. Roll Call – All members present.
2. Authorization to begin borrowing process for the 2020-2021 Capital Projects.

Staff has reviewed the Capital Improvement Plan (CIP).  Adjustments were made to the list based on timing of some projects and capacity to get the project done in the next 2-3 years.  The latest version of the CIP was provided.  Finance Department is seeking permission to begin the borrowing process for the list of 2020 Capital projects.  Questions from members were answered.

Motion by Coenen, seconded Moore to authorize the City Finance Director to begin the borrowing process for the list of projects shown on the Capital Projects 2020 Borrowing list for tentative bond selling date in September 2020.

3. COVID-19 Budget Impact.

Finance Director Van Rossum provided information on the COVID-19 2020 Budget impact.  The revised list included input from City staff.   Discussion was held on the impact COVID-19 has on the City Budget.  A grant program is available and the potential for revenue relief is being looked into.  Questions from the committee were answered.  Mayor Penterman stated that a monthly update will be given on the COVID-19 budget impact.

A meeting of the Health and Recreation Committee was called to order by Chairman Duda on Monday, June 15, 2020 at 6:56 p.m. remote teleconference via ZOOM.

Mayor Penterman stated tavern owners have come a long way in reducing violations in their establishments.

3. 2020-2021 Beer and Liquor Licenses.

The list was distributed along with reference to a couple of establishments who have been tagged.

Motion by Roehrig, seconded by Schell, to grant the 2020-2021 Beer and Liquor Licenses contingent on all concerns being met.

4. 2020-2021 Outdoor Alcoholic Beverage Area Permits.

The list of five establishments were provided.

Motion by Roehrig, seconded by Schell approve the 2020-2021 Outdoor Alcoholic Beverage Area Permits.

5. 2020-2021 Sidewalk Display and Sidewalk Café Permits.

The list of one establishment was provided.  Ald. Roehrig asked why only one permit was applied for.  Principal Planner Watson Brunette stated that this year a letter was not sent to businesses.  The establishments may not be aware that these permits need to be renewed each year.

Motion by Roehrig, seconded by Schell approve the 2020-2021 Sidewalk Display and Sidewalk Café Permit.

Motion by Duda, seconded by DeCoster to approve the Health & Recreation Committee Meeting Minutes of June 15, 2020.

Ald. Coenen brought up the list of beer and liquor license establishments that were tagged.  He stated that one item was never addressed.  This item was the Kaukauna Athletic Club, tagged by the City Attorney, regarding the basis of granting a premises license to a private organization on property owned by the City.  The other items on the memo were addressed and given a time frame to be fixed, but this particular item was never addressed.  Attorney Davidson stated to bring this item back up, the Council member (Coenen) would need to make a motion to address this particular item.

Motion by Coenen, seconded by Schell to bring this tagged item back to the Health & Recreation Committee for review.  Ald. Duda asked if the City Attorney would be investigating this matter.  Attorney Davidson stated he would be investigating the history of this license and offer an opinion as whether or not it is appropriate.

A meeting of the Legislative Committee was called to order by Chairman Coenen on Monday, June 15, 2020 at 7:02 P.M.

2. Memorandum on proposed legislative change allowing leashed dogs in select City parks and open spaces.

Principal Planner Watson Brunette stated this topic has been brought to the Plan Commission and the Council, which was in turn referred back to the Legislative Committee for discussion.  This had originally come up during the most recent adoption of the Parks and Outdoor Space Plan.  There was an overwhelming interest in allowing more leashed dogs in City parks and open spaces.  The City Ordinance needs clarification on where dogs are allowed.  The signage in City Parks needs to be addressed.  Questions from the committee were answered.

Suggested language to the Ordinance on dogs in select City parks and open spaces should be brought back to the Legislative Committee for review.

Building Inspection Report

Motion made by Coenen, seconded by Moore to receive and place on file the May 2020 Building Inspection Report.  Ald. Moore asked what the current timeline is for when inspections are requested and then approved.  Mayor Penterman stated administrative help is being provided to the inspectors to get permits done in one to two days.  Planner Jakel stated the turnaround on new housing and commercial permits that requires state approved plans is about three to four days.  A huge amount of permits are coming in for pools, decks, fences and light alterations, which Planner Jakel feels they have a handle on.  The City could do a little better on the larger inspection permits.  Some user issues are being worked on for the State of Wisconsin software (Mygov).

Consideration of Miscellaneous Business.

Ald. Coenen thanked the Kaukauna Police Department on the excellent job they have done with the investigation and arrest for the murders in February.

Ald. Moore stated Kaukauna residents have called him about the registration and lack of concessions at the Kaukauna swimming pool.  He feels this item should be discussed at a future meeting.  Mayor Penterman asked Ald. Moore to call him to discuss this issue.

Ald. Schell wished Mayor Penterman a Happy Birthday.

Ald. Thiele asked to be included in communications about the swimming pool.  City Attorney Davidson stated that all policy issues and debate the Council has would need to be placed on an agenda and brought up at a public meeting.
